If the rideshare app is on but there is no passenger in the car and the driver is not currently en route to pick up a passenger, the rideshare insurance policy for both companies is reduced to $50,000 per person for bodily injury, $100,000 in total bodily injury per accident, and $25,000 in property damage. However, if the app is off Uber and Lyft are not liable, and the victim must pursue compensation from the at-fault driver’s personal auto insurance policy.
